Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the VerhaalPaden mobile application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

VerhaalPaden is an iOS application that generates interactive, AI-powered origin stories based on user-provided topics. The service uses artificial intelligence to create unique narrative content that users can guide through their choices.

Service Features

  • AI-generated story content
  • Interactive branching narratives
  • Multi-language support (English and Dutch)
  • Local story storage
  • PDF export functionality
  • Offline reading capabilities

3. Eligibility

You must be at least 13 years old to use this App. By using the App, you represent and warrant that you meet this age requirement.

4. User Responsibilities

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the App to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Use automated systems (bots, scripts) to generate stories
  • Attempt to circumvent rate limiting or other technical restrictions
  • Use the App in any way that could damage, disable, or impair the service
  • Attempt to gain unauthorized access to any portion of the App or its systems

Content Generation

You understand that:

  • Story content is generated by AI and may not always be accurate, appropriate, or suitable for all audiences
  • You are responsible for reviewing generated content before sharing it
  • The App may occasionally generate unexpected or inappropriate content despite our best efforts
  • Generated stories are not verified for factual accuracy

5. Rate Limits and Usage Restrictions

The App implements usage limits to ensure fair access and manage operational costs:

  • Current limit: 50 chapter generations per hour per device
  • Rate limits may be adjusted at our discretion
  • Attempting to circumvent rate limits may result in service suspension
  • We reserve the right to modify or remove access for users who abuse the service

6. Intellectual Property

Your Content

  • You retain all rights to the topics and directions you provide to the App
  • You own the stories generated through your use of the App
  • You are free to use, modify, distribute, and commercialize your generated stories
  • By using the App, you grant us a limited, non-exclusive license to process your inputs solely for the purpose of generating stories

Our Content

  • The App itself, including its design, code, and functionality, is protected by copyright and other intellectual property laws
  • The VerhaalPaden name, logo, and branding are our property
  • You may not copy, modify, or create derivative works of the App

Third-Party Rights

  • AI-generated content is created using Anthropic’s Claude API
  • Anthropic’s terms and policies apply to the AI generation process
  • We do not claim ownership of AI model outputs on behalf of Anthropic

7. Privacy and Data

Your use of the App is also governed by our Privacy Policy. Key points:

  • We do not collect or store your story content on our servers
  • Stories are stored locally on your device
  • We use anonymous device identifiers solely for rate limiting
  • We do not sell or share your personal information

8. Service Availability

No Guarantee of Availability

  • The App is provided “as is” and “as available”
  • We do not guarantee uninterrupted or error-free service
  • We may suspend or discontinue the service at any time without notice
  • We may modify features, functionality, or pricing at our discretion

Maintenance and Updates

  • We may perform maintenance that temporarily interrupts service
  • Updates may be required to continue using the App
  • Some updates may change or remove features

9. Third-Party Services

The App relies on third-party services:

  • Anthropic Claude API – AI content generation
  • Apple iCloud – Optional data storage (when implemented)
  • Cloudflare Workers – Backend infrastructure

These services have their own terms and privacy policies. We are not responsible for third-party service interruptions or changes.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND
  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED
  • WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR QUALITY OF AI-GENERATED CONTENT
  • YOU USE THE APP AT YOUR OWN RISK

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • THIS INCLUDES DAMAGES FOR LOST PROFITS, DATA LOSS, OR SERVICE INTERRUPTION
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE APP (CURRENTLY $0)
  • SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO THESE LIMITS MAY NOT APPLY TO YOU

12. Indemnification

You agree to indemnify and hold harmless VerhaalPaden, its developers, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you generate or share using the App

13. User-Generated Content and Sharing

When you export or share stories:

  • You are solely responsible for the content you share
  • We are not liable for how others use content you share
  • You should review content before sharing to ensure it’s appropriate
  • Sharing offensive or illegal content may violate these Terms

14. Termination

By You

You may stop using the App at any time by deleting it from your device.

By Us

We may suspend or terminate your access to the App:

  • If you violate these Terms
  • If you abuse the service or circumvent restrictions
  • If required by law or legal process
  • At our discretion for any reason

Effect of Termination

  • Your locally stored stories will remain on your device
  • You will lose access to story generation features
  • These Terms will continue to apply to your prior use

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective:

  • Immediately upon posting for non-material changes
  • 30 days after notice for material changes

Continued use of the App after changes constitutes acceptance of new Terms. We will update the “Last Updated” date at the top of this document.

16. Export Controls

You agree to comply with all applicable export and import laws. You represent that you are not:

  • Located in an embargoed country
  • Listed on any government prohibited or restricted party list
  • Prohibited from receiving products or services under applicable law

17. Apple App Store Terms

If you download the App from the Apple App Store, you acknowledge and agree that:

  • These Terms are between you and VerhaalPaden, not Apple
  • Apple has no obligation to provide support for the App
  • Apple is not responsible for addressing claims relating to the App
  • Apple is a third-party beneficiary of these Terms
  • Apple’s standard terms and conditions also apply

18. Dispute Resolution

Governing Law

These Terms are governed by the laws of The Netherlands, without regard to conflict of law principles.

Informal Resolution

Before filing any claim, you agree to attempt to resolve disputes informally by contacting us at info@sanderschat.nl.

19. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and VerhaalPaden.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment

You may not assign these Terms. We may assign our rights and obligations without restriction.
